in case you havnt read it yet, here is a part of the msn contract.

We consider your use of the Service, including the content of your communications, to be private.   We do not routinely monitor your communications or disclose information about your communications to anyone.  However, we may monitor your communications and disclose information about you, including the content of your communications, if we consider it necessary to: (1) comply with the law or to respond to legal process; (2) ensure your compliance with this contract; or (3) protect the rights, property, or interests of Microsoft, its employees, its customers, or the public.

Always use caution when giving out any personally identifiable information about yourself or your family.

This means that we are actually giving msn the power to moniter what we say.

what a bunch of spying.....

This beings me to another point. Is there actually any safe way of talking other than in person?

That's one of the reasons I hardly use MSN anymore. While condition 1) is wrong, it gives a proper explanation on when they will spy on you, when a court order has been acquired. However, conditions 2) and 3) are evaluated by definitions which are unknown to the public (Microsoft can consider any talk to be a interference with their interests, thus 3) applies)

There are third party clients for MSN available, which take away the problems and annoyances you have with the default MSN client (MSN Messenger) but they won't take away the bad things of the MSN network itself. However, maybe one of these clients uses encryption which can only be encrypted by the receiver (public key/private key)
I've checked some third party clients, and I found a partly positive answer with Miranda IM:

I think it requires you to setup some stuff, but if you want to shield your messages from Microsoft, this could be the way to do it.

Now that I went on searching, I'll think I'm going to use it myself. I value privacy maybe even more then free speech.

you know what I don't understand. . all the complaining against a software company which is using strategies most of you would also apply in those positions. And you still use the software. If you all hate it so much, please switch to Mac OS or Linux. Think most of you will come back crying to Windows.

Next to that. Your local phone company has the seem backdoor feature. Gon'na be pissed at them to ?
Expect anything, and life will become boring...
